The Pandemic as a Stress Test of the Patent System – A Legal-economic re-examination of exclusivity, liability rules, open innovation, and complementary policy levers


This project addresses the research questions whether the patent system a) provide sufficient exceptions to exclusivity; b) offer beneficial structures for open innovation; and c) needs complementary policy measures of for driving innovation in pandemic situations. The project is funded by Deutsche Forschungsgemeinschaft and led by researchers at the Ludwig Maximilian Univ. of Munich in cooperation with selected universities in Europe and Japan. Swedish participants are  Ove Granstrand (project leader),  Marcus Holgersson and Maximilian Forsell (RA). The Swedish part will especially deal with licensing issues.
